Psilocybin Mushrooms

Belgium's Annex IVB covers all parts of fungi, including mushrooms and truffles, that naturally contain psilocin or psilocybin. The 24 April 2024 amendment broadened the former genre-based wording and entered into force on 1 June 2024. As Annex IV products, these fungi are subject to the decree's authorization regime: import, export, transport, manufacture, production, possession, sale, supply, delivery, and acquisition require prior authorization limited to scientific or medical purposes; violations are punishable under Article 2bis of the 1921 drugs law.

Supported with a defined statutory-interpretation caveat. The official BVI consolidated Act expressly places Psilocin in Schedule 2 Part I (Class A) and extends that Part to an ester or ether of a listed substance, its salts, and any preparation or other product containing a listed substance or product. NIH PubChem identifies psilocybin as [3-[2-(dimethylamino)ethyl]-1H-indol-4-yl] dihydrogen phosphate, a phosphoryloxy tryptamine functionally related to psilocin, and identifies psilocin as a hallucinogenic alkaloid isolated in trace amounts from Psilocybe (magic) mushrooms. On that evidence, psilocybin and psilocybin-containing mushrooms are treated as falling within the Class A statutory coverage, but the Act does not print the words psilocybin, Psilocybe or mushroom and no BVI judicial decision resolving intact-mushroom classification was found. Sections 5-7 prohibit unauthorized import/export, production, supply and possession; section 11 separately prohibits smoking or otherwise using a controlled drug. Sections 5(2) and 9 preserve ministerial licensing/regulatory routes, and section 9(3) ordinarily requires lawful practitioner, druggist and retail-pharmacy activity, but no fetched source establishes an operational medical or research authorization specifically for psilocybin. Section 7(3) supplies presumptive supply thresholds only for heroin, cocaine, opium, morphine and cannabis/cannabis resin, not psilocin or psilocybin. The latest official consolidated text inspected is revision-date 1 January 2020 and lists historical amendments through 1996; the portal marks the Act current/in force, but this dossier does not infer that no later amendment exists outside the inspected portal materials.

The audited legacy entry (actionable, markerCount 0) said ‘Illegal’ but lacked claim-level sources. The current consolidated e-Sbírka schedule and operative criminal provisions support canonicalStatus prohibited. The schedule claim now uses the current e-Sbírka text effective 25 June 2026 rather than a stale non-consolidated Ministry of Health PDF; official Parliament records for Regulations 50/2026 and 107/2026 preserve the amendment lineage. The former Government Regulation 455/2009 numeric table for ‘more than 40’ mushrooms ceased to have effect under Constitutional Court judgment No. 206/2021 Coll.; it is not a current safe harbor or automatic criminal threshold. The current § 285(3) amount-greater-than-small standard and case-specific application remain controlling. The separate medicinal-psilocybin route concerns manufacturer-designated medicinal psilocybin and supervised healthcare use, not mushrooms.

As of 27 August 2026, Hong Kong's current Cap. 134 consolidation supports a prohibited result for psilocybin-mushroom preparations identified by the Police and Narcotics Division as containing psilocybin and psilocin. The statutory product coverage should be stated through First Schedule Part I paragraph 7, which expressly reaches a natural preparation or other substance containing any proportion of a paragraph 1-6 substance; paragraph 1(b) alone is not a direct psilocybin-mushroom citation. Sections 8, 4 and 5 address unauthorized possession/consumption, trafficking and supply/procurement, and section 6 addresses manufacture. Manufacture is not synonymous with cultivation: because section 9 expressly addresses cultivation of cannabis and opium poppy, this entry makes no independent mushroom-cultivation prohibition claim.

India's primary materials expressly schedule psilocine/psilotsin and psilocybine and restrict unauthorized operations involving those psychotropic substances under the NDPS Act and Rules. This entry is intentionally limited to mushroom material or a preparation whose species identity and chemical composition establish that it contains one or both scheduled compounds. The Act Schedule does not expressly name Psilocybe, ‘psilocybin mushrooms’ or any fungal species, and the fresh primary sources inspected do not resolve organism-level coverage for every whole mushroom or every species. Accordingly, do not treat every mushroom organism or unidentified whole-mushroom material as categorically prohibited on this record, and do not infer a general mushroom exemption; species/composition and the applicable authorization pathway must be assessed.

As of 27 August 2026, Irish law directly addresses the product commonly called magic mushrooms: the 2006 declaration says that any substance, product or preparation, including a fungus of any kind or description, containing psilocin or an ester of psilocin is a controlled drug and its explanatory note identifies such fungi as commonly described as magic mushrooms. The 2021 replacement Schedule 1 retains Psilocin, adds any fungus containing any proportion of Psilocin or an ester of Psilocin, and extends coverage to stereoisomers, esters/ethers, salts and preparations/products (subject to the Schedule 5 wording). The 2022 section 13 designation order makes Schedule 1 drugs unlawful for manufacture, production, preparation, sale, supply, distribution and possession except research, forensic analysis, essential industrial intermediate/starting-material and qualifying hemp purposes, subject to licensing and the Regulations. There is a narrow possession-only exemption for a fungus containing psilocin or an ester of psilocin while growing uncultivated; it does not authorize cultivation, harvesting, preparation, supply, sale or ordinary possession after removal. Ordinary practitioner/pharmacist supply and possession exemptions enumerate Schedules 2-5 (and specified Schedule 4 parts), not Schedule 1, so no ordinary patient prescription route is created. The current HPRA authorised-human-medicines XML published 2026-08-27 contained no psilocybin, psilocin or magic-mushroom identity match; that is a register limitation, not a claim that no exceptional authorization could ever exist. Ordinary section 3 possession is punishable under the current revised section 27 by up to a class C fine (not exceeding EUR 2,500) and/or 12 months on summary conviction, or a court-determined fine and/or up to 7 years on indictment; section 15 possession for unlawful sale or supply carries up to life imprisonment or a lesser term on indictment, and sections 15A/15B provide the separate drug-trafficking regime.

Supported replacement: Italy expressly schedules Psilocybe, Stropharia and Conocybe mushroom genera in Table I and separately lists psilocybin and psilocin. The D.M. 11 April 2006 schedule-limit table states that the mushroom entry is assessed by the psilocybin/psilocin active-ingredient content. Table I control applies in every product, mixture or preparation form. Article 73 criminalizes unauthorized cultivation, production, supply, sale, distribution, transport and non-exclusive-personal import/export/purchase/possession; Article 75 handles exclusive personal-use acquisition or possession as an administrative offence rather than making it lawful. This entry does not assert that every fungus or every mushroom species is controlled, and it does not claim a species-independent threshold or safe harbor.

Current Latvian primary law supports replacing the prior generic Illegal label with canonicalStatus prohibited. Hallucinogenic mushrooms are expressly placed in List I's plant-product entry, and § 5 prohibits ordinary cultivation, production, manufacture, import/export, distribution, advertising, transport, storage, transfer, acquisition, use and transit. The Annex 2 dried/undried gram bands classify amounts for unlawful-circulation offenses; they do not legalize amounts below a threshold. § 7 preserves only a tightly limited State Agency of Medicines authorization route for specified scientific, physical/chemical testing or training purposes.

Mexico's current federal health law classifies psilocybin, psilocin and hallucinogenic mushrooms in Group I of Article 245, defined as substances with little or no therapeutic value that, because they are susceptible to misuse or abuse, constitute an especially serious public-health problem. Article 247 covers planting, cultivation, harvest, preparation, acquisition, possession, commerce, transport, prescription, supply, employment, use and consumption of psychotropic substances and requires Secretaría de Salud authorization for the acts it allows; Article 248 then expressly prohibits every Article 247 act relating to Article 245(I) substances. Article 249 permits Secretaría authorization only for scientific research, under the control of that authority and an approved research protocol. The Federal Penal Code treats Article 245(I) psychotropics as narcotics for its health-crimes chapter. Without the corresponding health authorization, Article 194 provides 10-25 years' imprisonment and 100-500 days' fine-days for production, transport, trafficking, commerce, supply (including free supply), unauthorized prescription, import/export, financing/fomenting, or consumption advertising; Article 195 provides 5-15 years and 100-350 fine-days for possession intended for an Article 194 act; and Article 195 bis provides 4 years to 7 years 6 months and 50-150 fine-days for unauthorized possession not shown to have that purpose. Article 195 bis directs the Federal Public Prosecutor not to prosecute the latter possession offense for peyote or hallucinogenic mushrooms where quantity and circumstances indicate use in ceremonies, uses and customs of Indigenous or Afro-Mexican peoples recognized by their own authorities; this is a narrow non-prosecution rule, not a general recreational or commercial authorization. Article 198 separately penalizes planting, cultivation or harvest of hallucinogenic mushrooms, with a 1-6 year reduced penalty only for the specified low-instruction/extreme-economic-necessity field-labor circumstances; absent those circumstances, its stated penalties apply depending on trafficking purpose. No medical prescription pathway is created for ordinary Group I psilocybin mushrooms: the expressly stated exception in Article 249 is controlled scientific research, while Article 245 describes the group as having little or no therapeutic value.

Poland's official schedule expressly names PSYLOCYBINA (psilocybin) as Group I-P item 86 and Psylocyna (psilocin/4-HO-DMT) as Group I-P item 76. Article 32 classifies psychotropic substances into I-P through IV-P, and Article 33(2) provides that Group I-P substances may be used only for research, not ordinary medical use. Article 4(17) defines a preparation as a product containing at least one psychotropic substance; read with the schedule and the possession offence, this supports treating psilocybin-containing mushrooms as prohibited preparations/products, while the schedule itself does not separately name a mushroom species or spores. Unlawful possession is punishable by up to three years' imprisonment (Article 62(1)); a significant quantity carries one to ten years (Article 62(2)); a lesser case may carry a fine, restriction of liberty or up to one year (Article 62(3)). Article 62a permits discretionary discontinuance for an insignificant amount intended for the offender's own use, which is not legalization or an exemption. Unlawful production/processing is separately criminalized under Article 53 and unlawful market placement under Article 56. The 2025 and 2026 schedule amendments list changes to other entries and do not amend I-P item 86; the latest amendment was published 13 July 2026 and entered into force after 14 days (28 July 2026). The 2026 Act amendment was published 27 July 2026 and enters into force after 30 days (27 August 2026); its enumerated changes do not alter Articles 32, 33 or 62. The scope conclusion is substance-based: it does not assert that spores or every fungal specimen lacking psilocybin are independently scheduled.

Psilocybin mushrooms are prohibited under the Misuse of Drugs Act 1973: direct Class A listings of psilocybin and psilocin, rather than an analogue or blanket NPS provision, capture anything containing those controlled drugs. Singapore’s Central Narcotics Bureau identifies Conocybe, Panaeolus and Psilocybe fungi containing psilocybin as illegal under the Act. Trafficking, manufacture, import or export, possession, and consumption of controlled drugs are offences. Psilocybin and psilocin appear in the First Schedule in the revised edition published on 30 May 1997.

Supported replacement. Thailand's current FDA controlled-narcotics list (15 September 2025) names Psilocybe cubensis under Category V and points to the operative 2022 Category V notification. Thai FDA's species-specific page states that the Category V definition covers plants yielding psilocybin or psilocin and all parts, including caps, stems and spores. Unauthorized production, import, export, sale or possession is criminally punishable under the Category V provisions, and consumption and possession for consumption have separate penalties. The FDA maintains permit routes for regulated Category V production/import/export/sale/possession, but those authorizations do not make ordinary recreational cultivation, supply, possession or use legal. Psilocybin and psilocin are additionally listed as Category I controlled psychotropics.

Supported correction in precision. The current Bahamas legislation index lists the 1994 Application Order under current regulations (2009 Law Revision), and the operative order applies Part IV of the Dangerous Drugs Act to its Schedule drugs. Schedule I expressly names psilocine/psilotsin and PSILOCYBINE and gives their chemical descriptions. The Act defines 'psychotropic substance' to include any substance, natural or synthetic, or any natural material, and defines a preparation as a solution or mixture containing psychotropic substances or psychotropic substances in dosage form; it also deems a drug to which the Act or a Part applies a dangerous drug. Those provisions support controls for psilocybin or psilocin material and a preparation whose composition establishes that it contains a scheduled compound. They do not expressly list Psilocybe, mushrooms, fungi or intact whole-mushroom material, so this dossier does not assert categorical organism-level prohibition. Part IV makes import/export unlawful unless the person is a qualified person and follows Part V procedure; section 27(2) requires approval for Part IV drugs to state that they are solely for medicinal or scientific purposes. Section 10 permits rules controlling manufacture, sale, possession and supply, and sections 22-24 prohibit possession with intent to supply and supply/offer to supply except the Act's qualified-person authorization. Section 22 provides severe quantity- and circumstance-dependent penalties, while section 29(2) supplies the default penalty for offences for which no other penalty is provided. No inspected source establishes an ordinary patient prescription route or an authorized psilocybin-mushroom medicine. A 2024 proposed Application Order was inspected as a Bills-portal document; although it would revoke S.I. 77/1994, its placement as a bill and undated execution block do not establish that it replaced the current order as of 27 August 2026.

Corrected in precision. Brazil's current Anvisa-linked consolidated Portaria 344 expressly lists PSILOCIBINA and PSILOCINA (also PSILOTSINA) in Lista F2 and defines a proscribed substance as one whose use is prohibited in Brazil. Article 4 prohibits production, manufacture, import, export, commerce and use of proscribed substances and medicines, while preserving only activities by institutions authorized for strictly medical/scientific research purposes. Lei 11.343/2006 incorporates the Portaria-controlled substances into the statutory drug framework: Article 2 prohibits drugs and, subject to authorization and its narrow ritualistic-religious plant proviso, planting, cultivation, harvesting and exploitation of plants or substrates from which drugs can be produced. Unauthorized possession for personal consumption is addressed by Article 28's non-custodial measures; unauthorized production, sale, supply and related conduct fall under Article 33, whose caput penalty is 5-15 years' imprisonment and 500-1,500 day-fines. The compound schedule does not expressly list a mushroom genus, fungal species, spores, or a general botanical-use exemption, so this dossier limits the mushroom result to material containing psilocybin or psilocin and does not treat every fungus or spore as automatically scheduled. No inspected primary source establishes a special religious-use authorization for psilocybin mushrooms; the Article 2 ritual exception is not extended here by analogy to ayahuasca.

Psilocybin and psilocin are expressly named in List I, whose designation is high-risk substances prohibited for human and veterinary application. Article 30 prohibits ordinary handling and possession of List I plants, substances and preparations. Article 31 preserves an exception for limited quantities provided under the Act for medical, scientific, laboratory-research and educational purposes; Article 73(1) additionally provides an authorization route, requiring permission and limiting quantities, for specified production, acquisition, import, export, storage and use of List I plants, substances and preparations for those purposes and for maintaining the working condition of service dogs detecting narcotic substances. Because the Act defines a preparation broadly as any material containing a narcotic substance and applies the same controls to preparations, mushroom material containing either listed compound is covered. The 2026 official amendment was checked for currentness and does not alter the psilocybin/psilocin entries.

Psilocybin mushrooms are prohibited in Cyprus because the 2025 Controlled Drugs Amending Decree places psilocin and psilocybin in Part I—Class A Drugs, and includes any preparation or other product containing a listed Class A substance. Under the Narcotic Drugs and Psychotropic Substances Law, unauthorized production, preparation, extraction, supply, sale, delivery, purchase, and possession of a controlled drug are unlawful criminal offences; the decree was published on 5 December 2025.

Supported and normalized to canonicalStatus prohibited. The French schedule names whole hallucinogenic mushrooms, including Psilocybe, in addition to the active compounds psilocine and psilocybine. The latest fetched ANSM guidance (December 2024) identifies the amended 22 February 1990 order as the governing controlled-substance list and restates the prior-authorization prohibition for activities involving classified narcotics. The ANSM schedule reproduction is marked as consolidated to 1 January 2020; it is used for the quoted entries, while the later ANSM guidance confirms the amended order remains the operative instrument. No separate criminal penalty amount is asserted.

Supported as prohibited on a compound-specific basis. Psilocybin and psilocin are expressly listed in Greece's Table A, and Law 4139/2013 criminalizes unlawful handling of listed narcotics while separately penalizing personal procurement, possession and use under Article 29(1). The schedule evidence names psilocybin/psilocin, not a mushroom genus; therefore this replacement should not assert a separate blanket rule for every fungus, spore or non-psychoactive mushroom, and the old uncited wording should be read only for mushroom material containing a scheduled compound.

Supported current replacement normalized to prohibited. The Ministry of Health's current legal record marks Permenkes No. 15 Tahun 2025 Berlaku; its schedule expressly lists psilocin under PSILOSINA/PSILOTSIN and psilocybin under PSILOSIBINA as Narkotika Golongan I. Group I is limited to scientific-development purposes and is not used in therapy, while the Narcotics Law prohibits health-service use and permits only tightly authorized, limited scientific/reagent pathways. The official Narcotics Law text also criminalizes unauthorized planting, possession, production, distribution, sale, transport and use of Group I narcotics, with imprisonment and fines specified in Articles 111–116. The schedule names the active compounds rather than a Psilocybe genus or every mushroom species; this conclusion therefore covers mushroom material containing the scheduled psilocybin or psilocin compounds, and does not rely on the legacy uncited assertion about a separate 1983 mushroom-specific instrument.

The schedule names the active compounds rather than a mushroom genus or the colloquial phrase magic mushrooms. Section 1 nevertheless defines a dangerous drug broadly as a First-Schedule substance together with its salts, preparations, compounds, mixtures, solutions, and salts. The official Israeli government psychoactive-substances guide identifies psilocybin as a hallucinogenic substance found in certain mushrooms and describes the relevant mushrooms as fresh or dried, with ingestion as a common route. Read together with the express schedule entries, this supports prohibited status for mushrooms containing psilocybin or psilocin, while not deciding the status of non-psychoactive fungi, spores, or a sample whose chemical content is not established. Section 6 prohibits growing, producing, extracting, preparing, or manufacturing a dangerous drug without a Director's licence and provides a 20-year maximum; section 7 prohibits possession or use without permission under the Ordinance, regulations, or a Director's licence, with a 20-year maximum and a 3-year maximum where possession/use is solely for personal consumption. Section 12 permits use for treatment only where supplied under the listed professional conditions or by licence; the inspected materials do not establish a psilocybin prescription or general medical-use authorization. Section 13 prohibits import, export, facilitation, trade, other transactions, and supply absent statutory, regulatory, or licensed permission, and section 19a provides a 20-year maximum for that commerce-and-transit sign. The Ministry of Economy's Personal Import Order expressly excludes dangerous drugs, so ordinary personal-import rules do not legalize these mushrooms. The Israeli Police separately reported a 2015 arrest on suspicion of growing hallucinogenic mushrooms and seizure of suspected dried mushrooms, spores, mushroom powder, and a cultivation kit; that report is practical enforcement evidence, not a substitute for the statutory classification. The consolidated legal publication visibly retains items 12-13 and its update metadata includes the 2025 amendments; the inspected 2025 Gazette amendment adds other substances and does not replace these entries. No inference is made about a particular licence, research authorization, prosecutorial decision, or enforcement outcome.

Supported current primary-source result. The current MHLW-hosted Cabinet Order lists psilocybin (サイロシビン) and psilocin (サイロシン) as narcotics and designates any mushroom containing either substance or its salts as a narcotic raw-material plant, subject to the text's exception for items designated by the Minister. The MHLW's public-comment explanation states that, once designated, magic mushrooms are regulated under the narcotics law and that import, export, advertising, transfer, receipt, possession and use are each regulated; it also explains that coverage is based on the presence of the controlled constituent rather than species or form. The Act prohibits anyone from cultivating a narcotic raw-material plant except a narcotic researcher with the Minister's permission for research (Article 12(3)); unauthorized cultivation carries one to ten years'拘禁刑, with a commercial-purpose minimum of one year's拘禁刑 and a possible fine up to ¥5 million (Article 65). The Act separately restricts narcotic import/export to licensed operators, subject to a narrow Minister-authorized personal-treatment import/export route (Articles 13 and 17), and unauthorized narcotic possession, transfer, receipt or preparation is punishable by up to seven years'拘禁刑, or for profit one to ten years and a possible fine up to ¥3 million (Article 66). MHLW's risk profile for Psilocybe argentipes expressly states that use and possession are illegal. The public-comment record says academic research is not the target of the prohibition but requires a narcotic-researcher licence; medical administration requires a narcotic-practitioner licence. No ordinary consumer, recreational, or prescription exemption is established. The conclusion is therefore prohibited for ordinary unauthorized possession, use, cultivation and commerce, while preserving the expressly licensed research/medical and other statutory authorization pathways.

Luxembourg expressly schedules psilocin and psilocybin and extends the Article 7 regime to qualifying organisms that naturally contain a listed substance, including mushrooms, and to their reproductive or cultivation biological material. Illicit personal use, transport, possession and acquisition are criminalized by Article 7 of the 1973 law; Article 8 covers illicit cultivation and other supply-chain conduct for substances within Article 7. The psychotropic regulation preserves authorization-based exceptions for regulated operations, so prohibited means unlawful outside those authorization provisions. Legilux labels the consolidated regulation and statute as documentary consolidated texts; the regulation version inspected is expressly applicable from 13 July 2026, while the statute page identifies its latest consolidated version as applicable from 21 July 2023.

Naturally psilocybin- or psilocin-containing mushrooms are in List II, and Article 3 prohibits their possession, cultivation, manufacture, sale, supply, transport, and import or export. The Public Prosecution Service treats 0.5 g dried or 5 g fresh mushrooms as a small personal-use quantity for which there is in principle no targeted investigation. Psychedelic sclerotia do not fall under the Opium Act and may be cultivated and traded; spores and grow kits are outside the mushroom definition until mushrooms form.

Psilocybin mushrooms are prohibited narcotics in Norway. The current list expressly covers Psilocybe cubensis, Psilocybe semilanceata and mushrooms containing psilocybin or psilocin, including spores and cultivated, dried or otherwise processed mushrooms; pure psilocybin and psilocin are separately listed as P I and marked Forbudt etter § 5. Section 5 prohibits manufacture, acquisition, dealing, import, export, storage, possession and use, subject to any formally granted medical/scientific exceptions. Section 7 specifically treats cultivation of fungi for narcotics production as manufacture requiring authorization. This classification does not assert that no narrow statutory or licensed exception can ever apply.

The existing claim is corrected in an important respect: the current consolidated Resolution No. 681 text names Псилоцибин and Псилоцин in List I but does not contain the former fruiting-body wording. Resolution No. 934 separately lists Грибы любого вида, содержащие псилоцибин и (или) псилоцин (fungi of any species containing psilocybin and/or psilocin) as controlled plants. Federal Law No. 3-FZ Article 2.1(3) applies controls analogous to those for the substances contained in listed plants and their parts; Article 2 defines List I as prohibited circulation, subject to the statute's narrow stated exceptions. Resolution No. 934 sets the Article 231 cultivation thresholds for these fungi at 20 fruiting bodies (large) and 200 fruiting bodies (especially large), irrespective of development phase. This is prohibited, not prescription_only: the sources do not establish an ordinary medical or recreational exception. The schedule's preparation note extends control to preparations containing listed narcotic drugs or psychotropic substances regardless of quantity and neutral components. The cited instruments do not supply a single penalty for every conduct; the Criminal Code provisions are conduct- and quantity-specific.

The Enforcement Decree in force since 1 February 2026 assigns Article 2(3)(a) psychotropic drugs to Annex 3, which expressly lists psilocybin and psilocin. The Narcotics Control Act prohibits unauthorised possession, use, management, import, export, manufacture, sale, transfer, and provision of these substances. It separately prohibits extracting constituents from source plants or fungi, and prohibits their import, export, sale, transfer, smoking, ingestion, and possession for smoking or ingestion.

The current Swiss schedule expressly controls hallucinogenic mushrooms of the genera Conocybe, Panaeolus, Psilocybe and Stropharia in Verzeichnis d, and separately lists psilocybin and psilocin there. Switzerland therefore supports a prohibited classification for ordinary psilocybin mushrooms and their active compounds. Under the BAG's current Article 8 guidance, cultivation, import, manufacture and placing on the market are generally prohibited, subject only to statutory exception-authorisation pathways (including specified scientific research and restricted medical use). This result does not infer a blanket rule for every possession or consumption fact pattern beyond the cited provisions.

Supported replacement. Turkey's official Law No. 2326 treaty text places psilocybin and psilocin/psilotin in Schedule I and Article 7 supplies the prohibition and narrow authorization framework. The 2025 Interior Ministry / EGM report confirms that the 1971 Convention, Law No. 2313 and TCK Articles 188/191 remain part of Turkey's current drug-control framework. The treaty annex names the compounds, not a Psilocybe species or a separate 'magic mushroom' row; this finding therefore applies to mushroom material containing scheduled psilocybin or psilocin and does not assert that every fungus is independently listed.
