MDPV

Federally scheduled on October 21, 2011 under a temporary one-year DEA ban. Permanently added to Schedule I¹³⁹ in July 2012 under the Synthetic Drug Control Act (signed into federal law). Illegal to manufacture, buy, possess, or distribute without a DEA license. Additionally controlled at state level in numerous states including Alabama, Florida, Georgia, Indiana, Kentucky, Louisiana, Maine, Michigan, Minnesota, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Tennessee, Texas, Utah, Vermont, Virginia, West Virginia, and Wisconsin, with most state-level controls enacted in 2011.

The existing entry is supported but should use the canonical status Prohibited rather than the vague label Controlled. The current Anvisa annex expressly lists MDPV in Lista F1 and defines Lista F as substances whose use is proscribed in Brazil. Portaria 344's current text prohibits production, manufacture, import, export, commerce and use of proscribed substances, except activities by authorized bodies or institutions strictly for research and medical/scientific work. This result does not separately classify possession under criminal law or infer that an authorization exists for any individual or product.

Methylenedioxypyrovalerone (MDPV) is listed as item 17.1 of Schedule I to the Controlled Drugs and Substances Act, together with its salts, derivatives, isomers, analogues, and salts of those substances.²⁶ Except as authorized by regulation, possession, trafficking, importation, exportation, and production are prohibited. The Schedule I entry has applied since SOR/2012-176 was registered on 20 September 2012.

Supported correction of the legacy Restricted label. The operative Resolution 000116 of 27 January 2026 expressly lists MDPV as item 290 in Annex Technical 1, headed 'Listado de sustancias incluidas como sustancias de control especial y sometidas a fiscalización', with the chemical designation (R/S)-1-(Benzo[d][1,3]dioxol-5-il)-2-(pirrolidin-1-il)pentan-1-ona and the Green List II designation. I normalize the legacy Restricted label to canonical restricted_other because the schedule establishes national fiscalization and control, while the inspected provisions do not state a blanket criminal prohibition for every act or an approved prescription-medicine status. Annex Technical 4 rule 5 extends fiscalization to chemically possible salts and stereoisomers of Green List II substances unless expressly excepted. The current resolution supersedes the prior Annex Technical 1-4 text from its issuance date. No analogue coverage beyond the listed substance and the stated chemical-variation rule is inferred.

MDPV is not a separately named row in the fetched 2025 First Schedule. The supported classification is a structure-based application: the official NIH PubChem identity gives MDPV as 1-(1,3-benzodioxol-5-yl)-2-pyrrolidin-1-ylpentan-1-one, which has the 2-amino-1-phenyl-1-propanone/cathinone skeleton with an alkylenedioxy-substituted benzene ring, an extended alkyl chain at position 3, and nitrogen incorporated in a pyrrolidine ring. Those are the modification classes expressly described in Part II paragraph 11. The named exclusions in that paragraph do not include MDPV. A Cyprus court or competent authority would control any borderline chemical-identity determination. Class B status makes ordinary import, manufacture, supply and possession unlawful under Law 29/1977, subject to the Act's regulation, licence and professional exceptions; this is not a finding that an MDPV-containing medicinal product is authorized.

The current Danish controlled-substance order, effective 29 March 2026, expressly lists MDPV as List B entry B291. List B substances may only be used for medical or scientific purposes; the parent Act permits possession for a lawful prescription or requisition and otherwise prohibits handling under § 2. This supports the canonical status prohibited, while preserving the statutory authorization and prescription exceptions. The packet's historical statement that MDPV was added on 13 March 2009 was not needed and is replaced with the current listing; no claim is made about a particular product, formulation or penalty beyond the cited provisions.

The current Finnish controlled-substance schedule expressly lists Metyleenidioksipyrovaleroni (MDPV) by name and chemical description in psychotropic-convention list II (Liite II). The current consolidated schedule is in force and was consolidated 25 June 2026; its amendment metadata records 651/2026 as effective 10 July 2026 and changing only Liitteet I, III and IV, while 1119/2025 is the latest amendment replacing Liite II and retaining the MDPV entry. Liite II's closing language extends control to chemically possible stereoisomers, salts (including salts of listed isomers), and preparations containing listed substances. Narcotics Act § 5 prohibits production, manufacture, import, export, transport, transit, distribution, trade, handling, possession and use of a narcotic, subject to separately regulated medical, research, supervisory/control and industrial-use exceptions. The earlier packet wording describing MDPV as Appendix IV as of 28 June 2010 is not the current classification: the operative consolidated schedule places it in Liite II. No MDPV medicine or ordinary prescription product was identified in the inspected Fimea SPC/PL portal; the prescription decree's § 20 expressly bars psychotropic-list-I narcotics (with a special-permit exception) and does not itself establish a prescription authorization for this list-II substance. This result does not infer that every structural or pharmacological analogue is automatically controlled; the express stereoisomer/salt/preparation scope and separate statutory NPS/positional-isomer mechanisms are the limits established by the inspected sources. MDPV is expressly listed in Israel's First Schedule, Part I, item 10ג1, rather than covered only by an analogue inference. The consolidated schedule identifies the Hebrew and English names, the structural name 1-(benzo[d][1,3]dioxol-5-yl)-2-(pyrrolidin-1-yl)-pentan-1-one, and the synonym MDPV. UNODC's Israel legal-system record states that MDPV and butylone were scheduled in 2010 under Dangerous Drugs Notice (No. 2), 5769-2009; the fetched primary Gazette material did not establish the precise July date, so the prior July-2010/four-family wording is corrected rather than repeated. The 2012 Free Import Order treats dangerous drugs defined by the Ordinance and listed in its Fourth Appendix as outside the ordinary free-import regime; its Fourth Appendix expressly includes Methylenedioxypyrovalerone. The 2025 official amendment notice changes the First-Schedule chemical-group definition and inserts additional substances; it does not repeal or replace item 10ג1. As a First-Schedule Part-I dangerous drug, unauthorized possession/use is prohibited by Ordinance section 7, subject to permission under the Ordinance/regulations or a Director's licence and the permitted-transit exception. The government legal report quotes section 7(c)'s maximum of 20 years' imprisonment (or 25 times the statutory fine) for the general possession/use offense and 3 years (or the ordinary statutory fine) where solely for personal consumption. Section 6 separately requires a Director's licence for growing, producing, extracting or preparing a dangerous drug; the Ordinance's commercial movement provisions require authorization. These personal-consumption, transit and licensing provisions are limitations/exceptions, not legalization or unscheduling.

The current official Luxembourg schedule expressly names MDPV, correcting the packet's uncited generic note ('Controlled substance as of July 30, 2012.'). Under Article 1 of the psychotropic regulation, every Annex-listed substance falls under Article 7 of the 1973 anti-drug law. Article 7 criminalizes illicit personal use and personal transport, possession or acquisition, while Article 8 criminalizes illicit production, manufacture, preparation, import, export, sale, offer, circulation and supply-related conduct. The execution regulation provides only a tightly controlled authorization and medical-prescription pathway: pharmacies may dispense listed substances only on an original written prescription, renewal is prohibited, and ordinary prescriptions generally may not cover more than seven days. This does not make MDPV ordinary prescription medicine or OTC; no medicinal authorization conclusion is needed for the schedule classification. The consolidated Legilux pages expressly warn that consolidations are documentary and have no independent legal value; the Journal officiel acts and amendments remain authoritative. The 2026 amendment added items 64-66 (2-MMC, NEP and 4-BMC), while the current consolidation retains item 41 MDPV. No structural-analogue rule is inferred beyond the psychotropic regulation's expressly stated stereo-isomer, organism and biological-material clauses.

Ukraine currently names MDPV expressly in Table I List No. 2 of the Cabinet's controlled-substances list. The heading makes the control rule explicit: these are especially dangerous psychotropic substances whose circulation is prohibited. The consolidated list records that MDPV was added by Resolution No. 373 of 31 May 2010; the current list page shows later amendments through 2 June 2026 and still contains the MDPV entry. The prohibition covers unauthorized circulation rather than merely a prescription classification. The official Ministry of Health size tables identify MDPV as small up to 0.15 g, large from 1.5 g to 15 g, and especially large at 15 g or more; the intermediate interval is not labeled a large or especially-large size in that table, so quantity and other facts must be assessed under the applicable offense. For unlawful production, manufacture, acquisition, storage, transport or forwarding without intent to sell, Criminal Code Article 309(1) provides a fine of 1,000–3,000 non-taxable minimum incomes, corrective work up to two years, probation supervision up to five years, or restriction of liberty for the same term; Article 309(2) raises this to a 2,000–5,000-minimum fine or imprisonment up to three years for specified aggravating circumstances or a large amount, and Article 309(3) provides imprisonment of five to eight years for involvement of a minor or an especially large amount. Sale or possession/production with intent to sell is addressed by Article 307: four to eight years for the basic offense, six to ten years with confiscation for specified aggravated circumstances, and nine to twelve years with confiscation for the most serious listed circumstances. These are criminal sanctions; the precise charge depends on conduct, intent, amount, and aggravating facts.

Repaired after refutation of the stale date, repealed WA instrument and incorrect penalties. The current federal instrument expressly lists MDPV in Schedule 9 and commenced 1 June 2026; its Schedule 9 definition supports a prohibited classification subject to approved research and related exceptions. The federal explanatory statement makes clear that the Poisons Standard is incorporated by State and Territory legislation and does not directly apply in its own right. In Western Australia, current regulation 6 of the Medicines and Poisons Regulations 2016 adopts substances listed in the current Poisons Standard Schedule 9 as Schedule 9 poisons, and current Medicines and Poisons Act 2014 section 17 governs unauthorised manufacture, supply, use or possession, subject to its stated licence, permit and used-syringe disposal exceptions. Section 115 provides the general Schedule 9 penalty of a $45,000 fine and 3 years' imprisonment. The WA offence and penalty are a jurisdiction-specific implementation; no identical rule is claimed for every Australian State or Territory.

Corrects the legacy uncited entry using the current consolidated Decreto 867 portal, which identifies its latest version as 16-Sep-2023 and expressly lists MDPV in Article 1. The named insertion is Decreto N.º 1.524, promulgated 23-Nov-2015 and published 30-Jan-2016. MDPV is therefore normalized to prohibited, not merely restricted or prescription-only. The Article 4 treatment/personal-use language is a limited justification within the small-quantity offence and does not negate the Article 1 schedule classification. Law N.º 21.817 was published 23-May-2026 and directs a six-month update to Decreto 867 for low-quantity substances capable of serious toxic effects; no resulting replacement schedule was identified in the current official portal as of 27-Aug-2026, so no future amendment is inferred. The Chile dossier was inspected first; its schedule framework and generic isomer/ester/ether/salt rules are relevant, but its named example was Alfa PVP rather than MDPV, so this result relies on the directly inspected MDPV text in Decreto 867 and Decreto 1.524. The official Ley Chile reader returned HTTP 401 to direct text fetches in this environment; cited official pages were fetched through the BCN browser portal, and schedule text, version metadata, amendment text and relevant Law 20.000 provisions were inspected there.

Freshly fetched official NN 19/2023 confirms the generic cathinones structural rule in the Schedule I psychotropic-substance table. MDPV’s 3,4-methylenedioxyphenyl ring, extended alkyl side chain and pyrrolidine nitrogen satisfy that rule. NN 19/2023 states that the prior NN 13/19 and 134/21 lists cease to apply when the new list enters into force on 18 February 2023; the NN 19/2011 named-MDPV row is therefore not used as current support. NN 154/2024 was also inspected as the later amendment and does not add a named MDPV row. The claim is limited to generic structural coverage and does not assert an expressly named MDPV listing.

The packet's blanket status "Illegal" is substantively supported but is normalized here to canonicalStatus prohibited. The current e-Sbírka rendition (effective 25 June 2026) visibly lists MDPV in List 4 and identifies its chemical structure; the 2015 amending regulation shows that the replacement List 4 containing MDPV took effect on 1 October 2015. This is not an absolute ban on every licensed activity: Act 167/1998 §§ 3(2) and 4 preserve a permit-based framework, limiting Annex 4 substances to the research, scientific and very limited therapeutic purposes stated in the permit. No consumer, recreational or ordinary commercial exception was located in the current official texts inspected.

The existing entry’s statement that MDPV was controlled as of 2 August 2012 is directionally correct but too vague. The current ANSM compilation expressly places MDPV/MDPK in the examples under the generic cathinone-derived narcotics provision and attributes that provision to the 27 July 2012 amendment. The Ministry of Health’s PEPPS operational summary states that, absent express authorization, production, manufacture, transport, import, export, possession, offer, transfer, acquisition and use of substances classified as narcotics are prohibited. The ANSM compilation is an information-only consolidation: it says the legally opposable texts are the amended 22 February 1990 arrêté and published ANSM Director-General decisions. No claim is made that MDPV has an authorized medicinal presentation or ordinary prescription route.

The current consolidated Hungarian controlled-substance regulation dated 2026-06-29 expressly lists MDPV in the P1 psychotropic schedule and identifies its chemical name, formula, and InChIKey. The row's ** marker denotes stricter national control than the Psychotropic Convention minimum. Under the current activities regulation, handling listed psychotropic substances—including possession and use—requires an activity permit, and P1 use may be authorized only for research or industrial purposes (subject to the statutory exception). Accordingly, non-authorized MDPV possession, use, production, supply, storage, import/export, or transfer is prohibited. This does not assert criminal penalties or a product-specific medicine authorization; any exceptional authorized use remains subject to the applicable permit and statutory requirements.

The substance-level evidence supports a prohibited/controlled classification: the 11 May 2011 Ministry decree expressly added MDPV to Table I and supplied both its common name and chemical designation. A later official Gazzetta decree (10 February 2015) states that MDPV was already controlled in Italy and included in the Table I attached to the consolidated drug law. Normattiva's current-date view reports the D.P.R. 309/1990 text as vigente al 27/08/2026 and updated on 06/08/2026; Article 14's current text defines Table I as including substances with concrete risks of dependence and applies the controlled-substance framework to identified isomers, esters, ethers, salts and stereoisomers unless expressly excepted. The Ministry's current tables landing page and a linked monitoring PDF were blocked by site-verification pages, so the latest directly inspectable substance-level listing retrieved here is the official 2015 confirmation of the 2011 Table I entry. This result establishes scheduling, not a conduct-specific penalty analysis; penalties, personal-use treatment and any authorization questions require the relevant D.P.R. provisions and facts.

MDPV is expressly named in the current List I table under 'andere benamingen' (MDPV), with the chemical identity 3,4-methyleendioxypyrovaleron. The placement decree (Staatsblad 2015, 237) entered into force on 1 July 2015. Article 2 prohibits bringing a List I means into or out of the Netherlands, cultivating, preparing, processing, selling, delivering, supplying, transporting, possessing or manufacturing it. Article 10(1) provides up to six months' detention or a fourth-category fine for a non-intentional Article 2 violation; intentional possession (Article 2(C)) carries up to six years or a fifth-category fine, intentional preparation/processing/sale/supply/transport/manufacture (Article 2(B)/(D)) up to eight years or a fifth-category fine, and intentional import/export (Article 2(A)) up to twelve years or a fifth-category fine. Article 8 permits a ministerial exemption from Article 2 only under statutory conditions, and Article 8a allows conditions to be attached; this is not a general consumer or prescription exception. The finding is for exact MDPV/3,4-methyleendioxypyrovaleron and does not extend to an analogue, positional isomer, metabolite or other formulation without checking the applicable legal entry.

The current Roszdravnadzor copy of Resolution No. 681 is identified as the 30 June 1998 resolution in the edition amended 11 June 2025 and places «Метилендиоксипировалерон» in List I under Narcotic Drugs. Article 14(1) of Federal Law No. 3-FZ limits List I turnover to the statutory purposes in Articles 29, 34–36 and 36.2; it is not a general prescription, consumer or recreational authorization. Article 14(4) separately prohibits turnover of drug and psychotropic analogues. Resolution No. 1002's current row gives MDPV significant, large and especially large quantity values of 0.6 g, 3.0 g and 600 g for Articles 228, 228.1, 229 and 229.1; in the criminal-law formulation these correspond to amounts over 0.6 g, over 3.0 g and over 600 g, while quantities not exceeding the significant value may fall under conditional administrative treatment rather than becoming lawful. For unauthorized possession, acquisition, transport, manufacture or processing without intent to supply, Article 228 part 1 provides alternative sanctions including imprisonment up to 3 years at significant quantity, part 2 provides 3–10 years at large quantity, and part 3 provides 10–15 years at especially large quantity. Production, supply or forwarding is separately punished by Article 228.1: part 1 is 4–8 years regardless of amount; significant, large and especially large quantities trigger parts 3, 4 and 5 with ranges of 8–15, 10–20 and 15–20 years or life imprisonment respectively, subject to the statutory aggravating conditions. Article 229 covers theft or extortion (3–7 years basic; 6–10 years for listed aggravating circumstances/significant quantity; 8–15 years for organized group/large quantity or violence; 15–20 years for especially large quantity), and Article 229.1 covers cross-border smuggling (3–7 years basic; 5–10 years significant; 10–20 years large; 15–20 years or life especially large). Article 6.8 administrative liability for possession/handling without intent to supply is a conditional alternative for conduct not reaching the criminal threshold: 4,000–5,000 rubles or up to 15 days' arrest, with foreign nationals additionally subject to removal. Exact qualification depends on measured amount, intent, aggravating circumstances, and whether a derivative has its own independent schedule entry.

The Turkish Interior Ministry identifies the 22 March 2012 Official Gazette publication as the 2012/2861 decision and links its attached text. The official 2012 national drug report records MDPV in the EWS list and states that the listed substances were brought under Law No. 2313 by that decision. The latest official 2025 Türkiye Drug Report still identifies Law No. 2313 and TCK Articles 188, 190 and 191 as the core legal framework, and summarizes current imprisonment bands. Under current TCK Article 188(1), unauthorized manufacture, import or export carries 20–30 years' imprisonment and 2,000–20,000 days' judicial fine; Article 188(3) covers unauthorized domestic sale, offer, giving, dispatch, transport, storage, purchase, acceptance or possession with at least 10 years' imprisonment and 1,000–20,000 days' judicial fine (15-year minimum if the recipient is a child). Article 188(4)(a) increases the penalty by half when the substance is a synthetic cathinone or derivative; MDPV is a synthetic cathinone, so this aggravator is potentially applicable, subject to the facts and legal characterization in the case. Article 188(5) adds half for joint offending by three or more people and doubles the penalty for organized-crime activity. Article 191(1) provides 2–5 years for purchase, acceptance, possession or use for personal use; Article 191 generally provides a five-year postponement of public prosecution, at least one year of probation (extendable by up to two additional years) and possible treatment, with prosecution triggered by specified violations. The cited materials do not establish an authorized medical or prescription use for MDPV; the public-facing status is therefore prohibited, not prescription-only.

The UAE's official Schedule 5 expressly names MDPV as item 25 in the Cathinones group. Schedule 5 also extends the listing, where applicable, to stereoisomers, derivatives, metabolites, salts and preparations in any proportion. Article 10(1) prohibits importing, exporting, transferring, producing, manufacturing, bringing into the UAE, possessing or acquiring Schedule 5 psychotropic substances, and related activities. Article 10(2) permits monitoring of medical uses and scientific research for Schedule 5 only through the specialized scientific authorities and conditions established under the law; this is not a general consumer or prescription exception. Article 57 applies Schedule 10 to Article 10(1) violations. Schedule 10 Group 1 provides: less than 20 g, imprisonment and a fine of at least AED 100,000 (but personal-use/addiction cases are sentenced under Articles 41 and 42); 20–100 g, at least 10 years' imprisonment and at least AED 100,000; more than 100 g, life imprisonment and at least AED 500,000. Article 41(1) separately provides for unauthorized addiction or personal use of Schedule 5 substances: at least three months' imprisonment or AED 20,000–100,000; second occurrence within three years: at least six months or AED 30,000–100,000; third or later: at least two years and at least AED 100,000. Article 57 additionally states that trafficking or promotion intent, or involvement with a hostile group or organized gang, carries the death penalty. Article 42 bis creates a narrow port-entry monetary regime for a person who is neither a UAE citizen nor legal resident and is found entering with a narcotic or psychotropic substance for addiction/personal use (unless medically authorized): AED 5,000–1,000,000 as set by Cabinet resolution, with confiscation and destruction; it does not legalize possession or import. Foreigners convicted of crimes under the law are generally deported under Article 75, subject to its family-related exceptions.
