Risperidone

Risperidone orally disintegrating tablets are labeled "Rx Only" as a human prescription drug product, and the current DailyMed record reports no DEA schedule. Under section 503(b)(1) of the Federal Food, Drug, and Cosmetic Act, covered drugs may be dispensed only on a practitioner's prescription, subject to the statutory refill provisions. Section 503(b)(4) requires a drug subject to that prescription requirement to bear the "Rx only" symbol and treats a drug not subject to the requirement as misbranded if it bears that symbol; these provisions do not create a general controlled-substance prohibition on possession of risperidone.

Risperidone is listed by exact name in Schedule 4 of the Therapeutic Goods (Poisons Standard—June 2026) Instrument 2026, effective 1 June 2026. Schedule 4 covers substances whose use or supply should be by or on the order of a person permitted by State or Territory law to prescribe and which should be available from a pharmacist on prescription. Under section 60, Schedule 4 poisons generally may be supplied only by medical, dental, or veterinary practitioners acting lawfully or by pharmacists dispensing legal prescriptions, with limited emergency-continuation and specified wholesale supply exceptions. These Commonwealth classifications are recommendations implemented through State and Territory legislation, so applicable offences and exceptions depend on the jurisdiction.

Risperidone or its salts are listed without qualification in Canada's Prescription Drug List: Human Use, effective 19 December 2013. Under the Food and Drug Regulations, a drug on that list is a prescription drug and generally may be sold only by a person entitled under provincial law to dispense prescription drugs, upon receipt of a verbal or written prescription, unless the sale falls under section C.01.043. These federal provisions regulate the sale and dispensing of prescription drug products rather than establishing a general prohibition on ordinary possession.

Risperidone is expressly listed as ‘Risperidon’ in Anlage 1 of the Arzneimittelverschreibungsverordnung. Under section 1, medicinal products consisting of, prepared from, or containing an Anlage 1 substance may be dispensed only upon presentation of a medical, dental, or veterinary prescription, unless a later provision provides otherwise. Unless otherwise specified, this prescription requirement also applies to medicinal products containing, or supplemented with, the corresponding salts or hydrates of listed substances. Section 5 exempts medicinal products made by a homeopathic manufacturing method when their final concentration in the finished product does not exceed the fourth decimal potency. These provisions regulate the dispensing of medicinal products and do not by themselves establish the legal status of non-medicinal material containing risperidone.

Swissmedic's current active-substance list assigns human medicines containing risperidonum to Abgabekategorie B, and its authorised-human-medicines list identifies current Risperdal and Risperidon-branded products containing risperidonum in that category. Under Articles 40 and 42 of the Arzneimittelverordnung, Swissmedic assigns and publishes medicine supply categories, and Category B is the category of prescription medicines. Article 45 permits pharmacists to dispense some Category B human medicines without a contemporaneous physician's prescription in specified circumstances, including continuation of long-term medication for one year after the initial prescription. The authorised-medicines list does not identify the risperidone products in its narcotics-table field, so this classification concerns medicine supply rather than a general prohibition on possession.

Authorised medicinal products containing risperidone are prescription only medicines in the United Kingdom. The MHRA's list of marketing authorisations granted from 1 to 14 March 2025 identifies six strengths of Risperidone Grindeks as POM, which it defines as prescription only medicine. Under regulations 5(3)(a) and 214(1) of the Human Medicines Regulations 2012, a medicinal product whose authorisation makes it available only on prescription is a prescription only medicine and may be sold or supplied only in accordance with a prescription from an appropriate practitioner, subject to the exemptions in Chapter 3 of Part 12. This product-based classification does not establish a general prohibition on personal possession of risperidone outside the authorised-medicine context.
